A generic consent form is an unfair trade practice

In 2020 the national consumer commission looked at a printed form that could fit any procedure and any doctor. It called the form unfair and deceptive and ordered ₹10 lakh to be deposited. No negligence was found.

Consent must be real and specific

The Supreme Court held that consent must be real and valid and given for the specific procedure. Consent for a diagnostic laparoscopy did not cover the hysterectomy done in the same sitting.

Doctors stay under the Consumer Protection Act

In November 2024 the Supreme Court declined to revisit its 1995 ruling. Complaints against doctors and hospitals continue to be heard by consumer commissions. Documentation decides most of them.

Electronic records need a section 63 certificate

Under the Bharatiya Sakshya Adhiniyam 2023 an electronic record is admitted only with a certificate that states its hash value and how it was produced. It has to be signed by the person in charge and by an expert.
